The Act Party is seeking legal advice to decide whether to go to police about New Zealand First's donations saga.

The Electoral Commission has contacted New Zealand First, following reports it's been filtering non-declared donations through a foundation.

Act leader David Seymour told Mike Hosking it appears people thought they were giving money to the party, when it actually went to the foundation.

"That's no different from me shaking the bucket for the Breast Cancer Foundation and then putting the cash into my beer fund, which is fraud and a crime."

Seymour says the public has the right to know who's funding political parties.

" It appears the donors thought they were giving money to New Zealand First but it went to the foundation, which could be fraudulent."
