Semenya case: Court rules restricting testosterone levels 'discriminatory' but 'necessary'

Commentators are claiming nobody wins following the Court of Arbitration for Sport's latest decision.

Double Olympic champion Caster Semenya has lost her appeal against the introduction of new rules regulating the testosterone levels for athletes with a difference in sex development.

The Court of Arbitration for Sport has dismissed her appeal, ruling restricting testosterone levels in female athletes in selected events, is "discriminatory" but "necessary".

Martin Gillingham told Mike Hosking there's a lot to consider and there's a high chance further appeals could be made.

"The reality is that it was a very, very tough call. It's been made now and we have to fully respect the decision that has been made but I do suspect that this may still have some way to run.

He said no one seems entirely convinced it's the right call and the debate will continue for some time.

"There is plenty of science out there that I don't think has been accepted by CAS."

"It is something that has become a human rights issues and that may well take it away from the court of Arbitration for Sport. I fear at one point that this will inevitably become a battle between Europe and Africa," Gillingham said.
