It's still unclear what law enforcement's role, if any, would be around compulsory scanning.
The Government is making it mandatory to use the Covid Tracer App or manually sign in to places.
It would come into force seven days, after the next alert level change.
The move would apply to the likes of cafes, libraries and nightclubs, but not supermarkets and dairies.
Otago University legal expert Andrew Geddis told Mike Hosking making it mandatory might be enough to remind people to do it, rather than Police having to step in.
“Though of course, there’s a bunch of rules that we already have that aren’t particularly enforced, such as say, wearing masks on public transport, you have to do it, but no one’s getting yanked off buses and fined for not doing it."
