Heather du Plessis-Allan: Trump is entitled to go to court - but there is no evidence

Here we are again, another day still unable to say who has won the presidency of the United States.

We are still waiting on the results to come through from those key states: Pennsylvania, Georgia, North Carolina, Arizona and to a lesser degree, Nevada and Alaska.

After a couple of days of missing in action, essentially disappearing from public view, Donald Trump has come out again and doubled down on his message that there is election fraud underway and that he is going to challenge it through the courts.

“If you count the legal votes, I easily votes. If you count the illegal votes, they can try to steal the election from us,” before citing big victories in states like Florida and Ohio.

“We won these and many other victories despite historic election interference from big media, big money and big tech.”

A number of major networks in the US – MSBNC, NBC, CBC and ABC News – all cut away from his speech.  They haven’t, from what I can see, explained why, but we can assume it’s because how inaccurate it was.

There are couple of things to note here.

Donald Trump is entitled to take this to court.  That is how their democracy works.  In fact, that’s how plenty of democracies work.  You have the ability to challenge processes in the courts.  It’s happened before.  You might remember the Supreme Court actually stopped the recount in Florida in the 2000 election.  And anyway, what is more American than suing something?

But that is different from the second thing he’s doing which is to allege that the vote is being stolen from him.

There is no evidence of voter fraud or election theft.

Honestly, it’s hard to know if Donald Trump is just saying this in order to save face in front of his supporters because he hates losing so much – or if he actually believes that this is happening.

Either way, it is a dangerous thing for him to allege without proof.  Not only does it risk eroding confidence in the US democratic system but it doesn’t feel like an exaggeration to say it runs the risk of sparking unrest.

We’ve all by now seen the boarding up of shopfronts in Washington and New York.  Facebook’s taken down a group called ‘Stop the Steal’ which was urging "boots on the ground to protect the integrity of the vote".  That group had grown to 365,000 members in one day.  It was adding 1,000 new members every 10 seconds.

Trump’s campaign is sending out emails urging supporters to ‘FIGHT BACK’.  Some of his supporters – some armed with rifles and handguns – have crowded outside election counting centres demanding the count stop.

As I say, it’s hard to know what Trump is really up to here.  Either he’s just packing a tanty because he’s not winning, or this is the most epic Trump Trolling yet.
