UPDATED 3.14pm: A hearing is underway at the High Court in Auckland where the Whale Oil blogger has applied for an interim injunction to prevent further publication of his emails.
However, Cameron Slater has chosen not to have his day in court, leaving it up to his lawyer to fight on his behalf.
Two protesters are outside the High Court in Auckland today where the blogger behind Whale Oil is applying for an interim injunction to prevent the media from publishing his stolen emails.
Long time anti-corruption advocate Grace Haden says the public has a right to see the emails.
"And as far as I'm concerned privacy is no excuse for criminal behaviour.
"Criminal behaviour needs to take precedence and that needs to be exposed."
John Key adds he's had nothing to do with the court action, and he's confident no one else in National has either.
He says National hasn't been involved in the attempt to gag the media.
"That's totally a matter for him. I wasn't aware of it, I'm not a part of it and he should just do what he wants to do and we'll carry on running an election campaign."
