UPDATED 3.16PM: Nicky Hager is facing a take it or leave it proposition over the handling of computers seized by police in October.
They were taken as part of the investigation into the identity of hacker "rawshark' and are currently sealed in the custody of the High Court.
Police want the computers cloned as part of their case, but Mr Hager doesn't want it to be done in a police laboratory, or solely by police staff, because the computers contain what he claims is information about corrupt senior police.
In the High Court today Justice Dobson's suggested he would direct a member of the Electronic Crimes Lab' to report directly to the Court on the cloning of the computers - a proposal Mr Hager's lawyer expressed reservations about.
Justice Dobson said if Mr Hager finds the option unacceptable he can reject it
