Nicky Hager's legal team has told the High Court the 10-hour search on his home and seizure of his property last October was illegal.

Police were looking for information on a hacker who passed on documents which formed the basis for Hager's explosive book Dirty Politics.

Lawyer Felix Geiringer said police had other ways to find the hacker, as well as inquiries underway that they should’ve made clear to the judge issuing the warrant.

"I submit that this is a failing of the police, not to be more forthright and candid over what was actually the state of the investigation at that point."

Geiringer said police should’ve finished investigating Slater’s computer and tweets linking to hacked information.

"The police - even on the first of September - recognised that a warrant for Mr Hager should follow the completion of these other two things."

"There's no information to suggest that they can narrow down who the hacker is from any one of Hager's contacts."

However lawyers for the Crown claimed Hager knew information given to him by a hacker had been taken illegally.

Lawyer Brendan Horsley told the High Court Hager claims he tested the motives of the hacker, to see if they were politically-motivated.

"It does not in any way, shape or form dispute the fact that this was material that had been obtained unlawfully."
