The barrister who's filed a class action on behalf of Bella Vista homeowners is confident they will get a good result.
Auckland QC David Heaney has taken up the fight on behalf of 21 property owners at Bella Vista, after they were told to leave ahead of Cyclone Hola.
Since then, dangerous building notices have been withdrawn from only three.
Mr Heaney is representing two of the 21 residents affected by the failed housing development.
He says the claim against the Tauranga City Council will be successful.
"They are charged with the task of making sure that all the building work in their area is up to standard and these homes are clearly not up to standard."
"Asking them to accept that at least the council has a liability to these people, but they refuse to accept that there's a liability."
