Updated 11:18am: John Banks’ lawyer is calling Kim Dotocm a liar, as he appeals the former ACT MP’s conviction for filing a false electoral return.

Mr Banks lawyer says the fact Mr Dotcom didn’t tell New Zealand authorities he was convicted of dangerous driving during his immigration process, shows he’s a liar.

He says Mr and Mrs Banks and Dotcom had lunch with two businessmen a few days before the cheques were signed.

While he claims the businessmen say they didn’t hear a mention of the donations, Mr Dotcom says they weren’t even at the lunch.  

Banks has wife's support

John Banks' wife is supporting her husband as he appeals his sentence for filing false electoral returns.

Amanda Banks is being questioned in the Court of Appeal in Wellington.

Banks is also supported by the former ACT Party member, John Boscawen and former National Party president, Michelle Boag.

Banks heads to court

Former MP John Banks heads back to court today, in an attempt to clear his name.

He was sentenced to community detention in August, after being found guilty of filing a false electoral return.

Banks has promised new and compelling evidence will be unveiled when he heads to the Court of Appeal today.

He hinted at it when announcing his appeal, straight after being sentenced in Auckland two months ago, but gave few details.

Banks has described it only as being new information, which contradicts evidence given in court.

He says it will clear his name for good.
