Jetlag and fatigue are being put forward as reasons the Malaysian diplomat facing sexual assault charges shouldn't be filmed in court.

Muhammed bin Rizalman has been flown back to New Zealand, to face charges of assault with intent to rape, and burglary.

He's due to appear in Wellington District Court, where lawyer David Stevens QC is opposing media applications to film him.

Justice of the Peace Hewitt Humphrey has heard Rizalman may be jet-lagged after flying back to New Zealand last night, and his tired appearance could prejudice a fair trial.

Police lawyer Grant Burston wants coverage applications to be deferred to Tuesday, when Rizalman's expected to appear before a judge.
