Trial begins for men accused of sexual violation

UPDATED 7.00pm: A defence lawyer is distancing a trial involving teenage sex and Facebook, from the Roast Busters case.

Two young men are on trial in the High Court in New Plymouth for allegedly having a threesome with a 17-year-old woman, who was too drunk to know what was happening.

The offending is alleged to have occurred when the men were 18-years-old and at a party in the township of Oakura on October 11th last year.

Both face charges of unlawful sexual connection and indecent assault.

One also faces charges of rape and making an intimate visual recording of the encounter and posting a video on a private Facebook page.

Defence lawyer, Susan Hughes QC, told the court this is not the Roast Busters.

She said although the woman regrets what happened, she consented to the activity and is lying about her complete memory loss of the incident.

Crown prosecutor, Cherie Clarke, said the woman was so drunk, she was in no state to consent to having sex.

She said the woman texted a friend the following morning saying, "Dear lord, what happened last night?"

It was only then she found out she had a threesome and went to police.

Ms Clarke told the court the woman can be heard saying something along the lines of "no stop - I don't want to be raped" in one of the recordings.

The accused have appealed the judge's decision to have their name suppression lifted.

The appeal is expected to be heard on Wednesday.

The trial has been set down for two weeks.
