Arun Kumar Trial: Wife breaks down giving evidence

UPDATED 12.13pm: It's been emotional morning at the High Court in Auckland, as a widow gave evidence in the trial of those accused of murdering her husband.

A 14-year-old is charged with murdering Arun Kumar in his Henderson store in June last year. A 13 year old is charged with Kumar’s manslaughter.

 

Anita Kumar broke down as defence lawyer David Niven continued to push her about her exact movements during the attack on her husband.

"To be honest, I cannot remember what actually happened that day."

The trial had to be briefly adjourned for the second time this morning, to allow Mrs Kumar to compose herself.

During questioning by Crown lawyer Keiran Raftery, Anita Kumar sobbed as she described the violent attack.

She says she tried to fend off one of the boys who was attacking her husband with a knife.

"After he had turned away, I saw blood dripping down and then I told him that he got hurt."

Mrs Kumar says blood began pouring from her husband’s wounds and he collapsed.

Earlier, the defence teams for two young teenagers on trial over a dairy owner’s murder delivered their opening statements.

The 14-year-old's defence lawyer Maria Pecotic says in pleading not guilty, the teen says he did not have the knowledge or intention to commit the charges which the Crown argues he did.

She says the boy did not act with murderous intent.

"We know Mr Kumar died, but that fact, that consequence was never anticipated, planned or contemplated."

One of the defence lawyers asked the jury to not let their emotions interfere with their job.

Philip Hamlin urged the dozen jury members to listen carefully to all of the evidence over the coming weeks.

"Please do not let sympathy, prejudice or an emotional response cloud your judgment."
