Simpson Grierson partner John Rooney told Mike Hosking it's quite different to being filmed.
"If it was, say, a CCTV, you're looking at all of the people who are in the store or the business, as opposed to targeting all the individuals when you don't have any particular reason to do so."
Rooney says the Privacy Act clearly sets out limitations.
