Lawyer: Immigration Minister 'can't boot refugees out'

A lawyer backs the claim Government had a hard task deporting the New Lynn ISIS-inspired terrorist.

The 32-year-old was shot dead by police who were monitoring him after injuring seven people in a knife attack at Countdown Lynn mall on Friday.

Despite the Sri Lankan national being on a terror watch-list the Government struggled to revoke his residency and says it left no stone unturned.

According to immigration lawyer Stewart Dalley, Waikato university law professor Al Gillespie and the ACT party, the authorities didn’t need to go through the rigmarole of stripping his refugee status: they could have simply kicked him while he was still a refugee. 

But Lawyer Marcus Beveridge disagrees, he says, when it comes to refugees the [Immigration] Minister can't boot them out - especially not to their country of origin.

He says if they could have proven he'd submitted false documents to obtain his refugee status it would have been possible, but they were too slow.
