Christchurch Mayor Lianne Dalziel is staying silent on Deon Swiggs, who was voted off the City Council in the recent elections.
Swiggs held the Central ward seat, and was investigated in September over complaints he'd sent inappropriate messages to young people and made them feel uncomfortable.
A petition's been lodged with the district court appealing the election, by a group claiming the complaints compromised the result.
Dalziel told Chris Lynch she won't comment on Swiggs or the petition while it's before the court - admitting she didn't know what she legally could say.
She says she hasn't seen or spoken to Swiggs since the election.
