Sleep-deprived Kapiti residents say the new expressway could be breaching their human rights.
Paraparaumu/Raumati Community Board member Bernie Randall has called on the Human Rights Commission to investigate noise complaints along the highway.
He said excessive night time noise can interfere with a person's right to a quiet enjoyment of their home.
Mr Randall said it's not that the NZTA isn't meeting night time noise standards, it's that there's a glaring gap between those standards and what's acceptable.
"NZTA are actually meeting their requirements legally under the board of inquiry standards but it is not fit for purpose for the residents because they are getting sleep disturbance," he said.
