The Government is being warned that it could find itself in a legal bind if it can't find people to replace the Partnership School Authorisation Board members.

All board members have announced they are not going to make themselves available for reappointment on March 1st.

ACT Leader David Seymour says under the Education Act, the board must contain five members.

"They will be breaking the law as of the first of March if they can't find people to go on the board. The way they are behaving, I suspect they won't be able to find five people in New Zealand who want to be part of their subterfuge of charter schools."

He says the fact they are all throwing in the towel shows how poorly the Government is handling charter school negotiations.

Seymour says the board was willing to work with the government in good faith, but feel that's not been possible.

"There were prepared to work with the Government and in only a few months they have been so dispirited by the Government's behaviour that they feel there is no point in them continuing."
