The Greens say the Government has no right to rely on ACT leader John Banks' vote as a minister.

And Greens' co-leader Metiria Turei is ramping up her demands for John Key to stand down the Epsom MP down from cabinet.

Police have decided NOT to charge Mr Banks over his mayoral campaign electoral returns, but Ms Turei says he's got off only on a technicality and she has no doubt he was in the wrong.

She believes Mr Banks has no credibility and the Government shouldn't take his ministerial vote.

"He can choose to vote for it if he likes but not as a minister of the Crown. He no longer has that right in my view. The public expect their ministers to act with the highest ethical standards. That is not the case here. He has failed to meet those standards and he should be stepped down as minister."
