Questions are being asked around whether overseas diplomats should be above New Zealand law.

A Wellington landlord's more than $20,000 out of pocket after EU diplomat Eva Tvarozkova up and left eight months into a three-year lease.

The Tenancy Tribunal ruled in favour of landlord Matthew Ryan, but the Ministry of Foreign Affairs has now requested a new tribunal - citing diplomatic immunity.

Ryan told Mike Hosking not having the rent is frustrating, but the principle is even more so.

"We shouldn't have diplomats coming to New Zealand and simply hiding behind immunity."
