Govt cleared of breaching Treaty when negotiating TPP

UPDATED 11.19AM The Trans-Pacific Partnership may not be an actual Treaty breach, but the Government is still not totally in the clear.

Claimants went to the Waitangi Tribunal with concerns the treaty clause wasn't strong enough, and gave too much power to foreign investors.

But the tribunal has now ruled there's a "reasonable" degree of protection to Maori interests.

However, it does also note the fear of investors suing our Government is a concern, saying the issue deserves more public scrutiny.

The tribunal said there are concerns including misjudging Maori interests, and a lack of transparency on Maori advice.

Trade Minister Todd McClay said they did talk with Maori, and are still doing so.

"TPP was the most wildly consulted free trade agreement we've ever negotiated, but it was over seven years and so much of that discussion and consultation stretched over a period of time."

Now the Government has been cleared of breaching its Treaty obligations, Mr McClay said it shows the safeguards in the trade deal are an achievement and a credit to the Government.

He said the decision itself shows how hard it is to sue the Government.

"Well there's possibilities of being sued all the time, actually this case being taken to the Waitangi Tribunal is an opportunity for those who may have a different opinion to test that opinion, and in this case it found the crown was right."
