Updated 5:30pm: A battle may be brewing between local council's and the Government over the sale of legal highs.

Councils are being urged to be sensible, amid a pushback about setting their own policies for when and where legal highs can be sold.

Legal highs are temporarily banned, however the Government intends to lift that ban midway through next year, allowing them to be sold again.

Wellington City councillor Paul Eagle's suggested restricting sales to one spot by the capital's Southern Landfill, to avoid upsetting inner-city residents.

He says people in the Capital are clearly saying no to the sale of legal highs at all, and they're not the only ones.

"I know in Wanganui 700 people have written in as part of their policy submission."

In central Otago the mayor is on record saying that this is ridiculous, this is a total waste of time and rate payers money."

Associate Health Minister Peter Dunne says councils asked the government not to impose a one-size-fits-all plan - and got their wish.

"I think Southern Landfill might be a somewhat extreme example, but if Paul Eagle is saying the Wellington City Council wants to be able to determine for itself how and when legal highs will be sold in Wellington, well that's the power it asks for and it's got."
