IPCA: Police right not to prosecute Banks

The Independent Police Conduct Authority says police were right when they decided not to prosecute John Banks over his Mayoral election returns.

Now that final court proceedings are over - with the Court of Appeal quashing his conviction and ruling that there should be no re-trial - the IPCA has released its own ruling on the case.

It says it was reasonable for police to decide they couldn't prove beyond reasonable doubt that Mr Banks had signed his electoral return in 2012 knowing that donations were falsely recorded as anonymous.

Chair Judge Sir David Carruthers says the police investigation was thorough and robust, and not subject to political interference.

After the police decision, serial litigant Graham McCready took a private prosecution, which was then taken over by the Crown, Mr Banks was initially found guilty but has now been cleared.
