Updated 2:11pm: A seven-day sex trial in New Plymouth is boiling down to one question – was the drunken complainant in a state to give consent?

The 18-year-old woman accuses two teens of sexually violating her at a party last year, when she was too drunk to know what was happening.

In her closing address, the Crown solicitor told the jury the teen had drunk at least a 1.5 litre bottle of cider and two vodka drinks in the three hours before the alleged offending.

She said witnesses who saw Facebook videos of the incident, said the woman was “just lying there”.

The defence said her memory loss is convenient and doesn’t give her licence to re-write history. 

In her closing address, the Crown reminded the jury, you don’t need to scream, have ripped clothes, and cry, to be raped.

She said the complainant was too drunk to consent, let alone put up a fight.

Teen in alleged rape video 'not in danger'

The High Court in New Plymouth has heard a group of teenage boys, who saw videos of an alleged rape, didn’t think the woman was in danger.

An 18-year-old woman accuses two young men of having a threesome with her, while she was too drunk to know what was happening.

The encounter was videoed and circulated on a Facebook page that about 20 boys had access to.

One young man told the court he was with a bunch of laughing boys when he first saw the video.

He later felt concerned the incident had been filmed.

A few witnesses said they were confused, as the woman was saying “no” and “I’m trying not to get raped” in a playful tone.
