Samoan man fails deportation protest

| New Zealand News | Wednesday September 5 2012 16:44

A Samoan national jailed for nearly five years for having a sexual relationship with a Rotorua teenager, has failed in his attempt to stay in New Zealand.

Pelesasa Tiumalu was jailed in 2010 for unlawful sexual connection with a person under 16, after his relationship with 15-year-old Hayley-Ann Fenton.

Fenton later overdosed after a barrage of text abuse from Tiumalu's wife.

Mr Tiumalu had protested the deportation order on humanitarian grounds, saying he'd find it tough to get work in Samoa and would have to leave his family.

Melissa Poole, from the Immigration and Protection Tribunal, says while there were a number of compelling reasons for Mr Tiumalu to stay, the offending warranted deportation.

She says he exploited the innocence and naivety of a 15-year-old who was ill-equipped to deal with his attention.
