The lawyer for a man accused of assaulting cricketer Jesse Ryder is looking at getting the charges dropped.

Jonathon Eaton told the Christchurch District Court this morning he's looking to apply for a stay of proceedings as he doubts his client can get a fair trial.

The 37-year-old's facing two charges - one of assault, the other of injuring.

His 20-year-old nephew has this morning pleaded guilty to assaulting Ryder.

Judge John MacDonald agreed with the police and lawyers' arguments that lifting name suppression would risk fair trial rights so that suppression's been extended.

The men will be back in court next month.
